Lawful Permanent Residency

In order to have the option of employing international faculty for an extended period of time (long-term), the UND department/school may need to begin some immigration procedures early in the faculty person’s stay.

The department/school needs to keep two things in mind – the employee’s current employability (as an H-1B or J-1) and their potential extensions of that employability. While H-1B or J-1 applications are pending (for the employee’s status is just beginning), the department/school and employee may need to be simultaneously working with an immigration attorney on the first step of employment-based Lawful Permanent Residency (which is immigration vocabulary for long-term employability). The UND Office of International Programs does not do Lawful Permanent Residency processing. The Office of International Programs recommends that the department/school contact an immigration attorney.

The employment-based Lawful Permanent Residency process has three steps. The first two steps are employer-initiated and the last step is alien/employee initiated. In the most common method of getting permanent residency for an international faculty member, the first employer step is called Labor Certification. This step with the North Dakota Labor Department must be initiated with 18 months of the job offer, not the starting date of employment. Once the Labor Certification has been completed, the employer has the option at that time to continue or stop the process of sponsoring the alien for permanent residency.

The three steps in this kind of Lawful Permanent Residency are:

  1. Labor Certification (Employer must do within 18 months of job offer)
  1. The Employer must file a Form I-140 with the USCIS.
  1. The Employee must file a Form I-485 with the USCIS.

It is up to the department/school and the individual as to who will pay for all or part of the application process.
